Who can obtain refugee-status?

 

The Republic of Hungary shall grant refugee status to an alien who, owing to a well-founded fear of being persecuted for reasons of race, religion, nationality, political opinion or membership of a particular social group, is outside the country of nationality and is unable or, owing to such fear, is unwilling to avail himself or herself of the protection of that country.

A well-founded fear of being persecuted may be based on events which have taken place since the applicant left the country of origin, or on activities which have been engaged in by the applicant since he/she left the country of origin.

An applicant who files a subsequent application shall not be granted refugee status, if the risk of persecution is based on circumstances which the applicant has created by his/her own decision since leaving the country of origin, and if such refusal is not in violation of the Geneva Convention.

 

Who can obtain subsidiary protection?

 

The Republic of Hungary shall grant subsidiary protection status to an alien who does not qualify as a refugee but in respect of whom substantial grounds have been shown for believing that the person concerned, if returned to his or her country of origin would face a real risk of suffering serious harm, and is unable, or, owing to such risk, unwilling to avail himself or herself of the protection of that country.

A well-founded fear of being persecuted or a real risk of suffering serious harm may be based on events which have taken place since the alien left the country of origin, or based on activities which have been engaged in by the alien since he left the country of origin.

 

How can you apply for asylum?

 

An asylum procedure is opened when the application for recognition is submitted at the refugee authority. A person seeking recognition of refugee status shall act in the asylum procedure in person. A person seeking recognition of refugee status shall present his/her application for recognition to the refugee authority in person.
